National Rules

Article 1 of the Regulations states:

“1.2       Associations are required to implement and enforce at least these minimum standards/requirements in accordance with the duties assigned in these regulations, subject to the mandatory laws and any other mandatory national legislative norms applicable to the associations. Associations shall draw up regulations that shall incorporate the principles established in these provisions.

1.3        The right of associations to go beyond these minimum standards/requirements is preserved.”

In essence, whilst national associations are required to implement and enforce FIFA’s Regulations:

  1. this duty is subject to national laws – if the law of a county requires a contrary position to that adopted in the Regulations on any particular issue, the national association is permitted to introduce alternative rules as are necessary;
  2. associations are required to draw up regulations that “incorporate the principles” set out in the Regulations; and
  3. associations are free to implement supplemental rules which “go beyond” the minimum standards / requirements in the Regulations.

 

As such, in many countries, the national system for the engagement and registration of intermediaries may be significantly different to the position set out under FIFA’s Regulations.

The English Football Association

The English Football Association was the first national association to release domestic regulations supplementing the FIFA Regulations on Working with Intermediaries. The national system implements the intermediary registration system whilst retaining many of the features of The FA's Agents Regulations.
